For Parliament is currently a bill amending the law on right to information about the environment. Since it is proposed to boost the initiative and response duty of government to provide public national food industries information about imminent pollution or significant changes in the environment. Flutningsmenn and mine are MPs Skúli Helgason, Mord Arnason and Birgitta Jónsdóttir.
Occasions of this bill is called dioxin issue since last year when up came the high dioxin contamination from several waste incineration plants. It was revealed that government agencies saw no reason for much action national food industries and not considered material to inform residents in the immediate national food industries vicinity of the headquarters of the risk at hand was. The response of the system was successful both glide long slow and erratic, but all cited the applicable laws and regulations to protect their omission. We were harshly reminded of the importance of sharpening the response duty of government and public institutions to the public in environmental issues.
Following the first news of the case decided Environment Parliament to examine more closely the environmental legislation and government requirements relating to contamination issues. national food industries I took on this task and returned Committee report on what improvements could be made in the current legislation. This report national food industries is available on the Parliament website (click here). My conclusion was that the provision would clearly define the initiative and response duties administrations in Icelandic law and the public's right to protect their quality of life and health.
The changes proposed in the bill aimed at consolidating the public against the government, tighten the disclosure of government and ensure people's right to live in healthy conditions and preserve their quality of life. Currently, the government should only provide information for environmental and pollution issues "request". We suggest that the word "request" will be eliminated 5th Article. current law. Then we propose that the 10 Article. Act added a new important paragraph that reads as follows:
"The Government is always required national food industries to initiate disclosure is reason to believe that significant deviations due to pollutants in the environment can cause a hazard or adverse effect on the environment or health of people or animals."
In current law (23/2006) stated that their goal is to ensure national food industries public access to environmental information that governments have at their disposal or stored on their behalf, to promote stronger awareness of the issues around the field, free exchange of ideas and increased public participation in decisions on environmental issues. The law was passed in order to implement the European Directive on public access to environmental information and the emphasis is on the public's right to information and the duty of government to provide information and communicate them readily and systematically. In the opinion of barristers, however, neither the Act nor the Directive expressly provides for mandatory government initiative, since they do not involve direct orders to the government to provide unsolicited information or warnings because of pollution.
It has been suggested that the EU directive is not unequivocal but flutningsmenn believe national food industries that it can be understood, however, in such a way that the government has initiated a mandatory disclosure when contamination is present. But though the Spirit hovers over the waters we believe inevitably sharpen initiatives related with direct legal requirements.
In this context it should be pointed out that the recommendations of the Constitutional Council of a new constitution is expected the new provision (35.gr.) on the disclosure of government regarding the state of the environment and nature and effect there. In the said provisions are government mandated, directly to inform of imminent natural hazards, such as environmental pollution. This further supports that the legal framework will be adapted to this perspective.
